Judge Gbeisay Denies Expert Witness Testimony, ‘Call Log’  Evidence-In Controversial Simon Grann ‘Last Will’

The Judge of Civil Law Court “B” at the Temple of Justice in Monrovia, Yamie Quiqui Gbeisay has denied the Objectors’ expert witness in identifying the original signature, and their request to the court to summon the call log between Senator Varney Sherman and the late Simon Grann in an ongoing lawsuit against the probating of what is said to be the last Will of the late Grann.

Judge Gbeisay denied the Objectors’ second witness, James E. Moore, Deputy Chief of Forensic and head of ‘question documentation’ examination at the Liberia National Police (LNP).

The Deputy Chief of Forensic at the LNP, Mr. Moore was presented by the Objectors as expert witness to ascertain the signatures on several documents presented by the Sherman and Sherman Law Firm to the court concerning the controversial last Will of Mr. Simon Grann.

Judge Gbeisay ruling to deny the deputy Head of the LNP forensic and question documentation department came from the background when Mr. Moore said in court that he needed one week to determine the

authencity of the signatures on the document shown him to testify if the signatures were genuine.

“This is a document that needs to be analyzed carefully because my opinion and facts on this matter in court will determine the outcome of this matter,” expert Moore admitted. “ I can assure this court that given all of the other schedule, maybe one week will be sufficient,” the Deputy Chief of Forensic assured.

But judge Gbeisay in upholding the Defendant’s objection to the Objector request for one week to properly verify the signatures said, the request of the Objector was strange in the legal practice.

Judge Gbeisay: “This court says such a practice is strange not only in this jurisdiction wherein a jury has been empaneled and a counselor –at – law especially a professor of

the law school… It is privity of reasons and for lack of common sense to say the jury trial will be suspended for a week to make research.”

Additionally, the Objector’s request to summon the call log indicating a call between Counselor Varney Sherman and the late Seimon Grann before he died was again denied by judge Gbeisay.

According to court records in the possession of this paper, Cllr. Sherman told the court that before Mr. Grann died he was in the United States and the late Grann called him and gave several instructions pertaining to the implementation of his Will.

But while on the witness stand, the Objector requested the court to summon the call log so as to prove if Mr. Grann indeed called Cllr. Sherman while

he, Sherman who was in the U.S. was called by Mr. Grann and was given instructions to implement his Will.

But Judge Gbeisay denied the request on ground that the court could not halt the ongoing testimony of Cllr. Sherman and summon the call log to prove or disprove the assertion.

However, the Objector took serious exception to judge Gbeisay’s  ruling on the request to have the call log summon in the matter.

Cllr. Varney Sherman and the Sherman and Sherman Law Firm is accused by the adopted and only son of the late Seimon Grann, Mr. Joseph Grann of faking the Will of his father.

According to court records, Cllr. Sherman’s law firm drafted the “last Will” of Mr. Simon Grann with all witnesses to the document being from the Sherman and Sherman Law firm while at the same time, Cllr. Sherman was allegedly instructed by Simon Grann to allot his Will.

During the allotment in the purported last Will nothing was mentioned for Mr. Joseph Grann.
